Oregon Problem Gambling Services Fall 2020 Online Learning Series: Presenter Agreement

Terms


  1. Consideration. As consideration for services to be rendered by Presenter, OCPG shall provide the Presenter or Presenter’s affiliation with honorarium in the previously agreed upon monetary terms payable by check within 30 business days following the event. Reimbursement for any approved expenses incurred and remainder of the presenter fee will be combined into one check unless requested otherwise by the Presenter. Presenter agrees to be available as needed for a technical rehearsal of the webinar within an agreed upon time prior to the event.
  2. Presenter Relationship. The Presenter is an Independent Consultant/Contractor for whom no Federal or State Income Tax will be deducted by OCPG, and for whom no retirement benefits, social security benefits, group health or life insurance, vacation and sick leave, worker’s compensation or other benefits will accrue. Presenter is not an employee, servant, or agent of the OCPG or Oregon Problem Gambling Services. Work at any time contemplated by this Agreement shall not represent Presenter’s opinions to be that of the OCPG or Oregon Problem Gambling Services.
  3. Material. To the best of Presenter’s knowledge, the presentation does not violate any proprietary or personal rights of others (including any copyright, trademark and privacy rights), is factually accurate, and contains nothing defamatory or otherwise unlawful. Presenter has the full authority to enter into this agreement and have obtained all necessary permissions or licenses from any individuals or organizations whose material is included or used in my presentation. Presenter understands that the presentation materials will be reviewed for accuracy and to ensure the presentation is educational in nature, and that Oregon Council on Problem Gambling reserves the right to make changes to any materials, with presenter approval.
  4. Recording Release. Presenter agrees that the OCPG may record the presentation identified above. Presenter understands that the recordings may be retained by OCPG and made available without charge to others, including presentation attendees. Presenter further understands that this agreement in no way affects the ability to publish the presentation as presenter sees fit and makes no other claim than permission to OCPG to record, retain, distribute or destroy this recording.
  5. Force Majeure. In the event that Presenter is unable to appear or OCPG is unable to offer the presentation due to proven detention by labor difficulties, civil tumult, strike, epidemic, war, acts or regulations of public or OCPG authorities (including, without limitation, social distancing measures to limit the spread of a contagious disease), severely inclement weather, interruption or delay of transportation service, acts of God, terrorism, arrest or conviction of Presenter for behavior in conflict with the mission of the OCPG, or any cause beyond the control of Presenter and OCPG, each party shall bear its own costs. In the event the OCPG program is cancelled or interrupted pursuant to this section, upon OCPG’s request, Presenter and OCPG shall use their best efforts to reschedule the program on a future date mutually acceptable to Presenter and OCPG, for the original fee.
  6. Sickness or Injury. In the event Presenter shall become unable to appear, present, or perform as a result of proven detention by sickness or injury, then Presenter shall promptly notify 8. Upon OCPG’s request, the parties will use their best efforts to reschedule the OCPG program or Presenter shall make every attempt possible to provide a qualified substitute presenter.
  7. Indemnification. Presenter shall indemnify and hold OCPG, its officers, employees, and agents harmless from and against any and all liability, loss, and expense (including reasonable attorneys’ fees) arising out of the matters described herein caused by or resulting from the intentional, wrongful, or negligent acts or omissions of Presenter, its officers, employees, and agents.
